Health Guarantee
The health and happiness of our puppies are the highest priority at Heaven Sent Toy Yorkies. Please read and agree to the following Health Guarantee Terms and Conditions before purchasing and taking home your new puppy
Veterinary Care & Health Certification
All puppies receive comprehensive veterinary examination at approximately 7-8 weeks of age prior to going to their new home each buyer will receive a health certificate via email from a licensed veterinarian confirming that the puppy has been examined and found free of any life-threatening health conditions at the time of the exam.
One-Year Congenital Health Guarantee
If the buyer complies with the required veterinary examination, the seller guarantees the puppy until one (1) year of age against life-threatening congenital defects of the heart lungs kidneys and liver only
If a licensed veterinarian confirms a life-threatening congenital defect within the first year
- The buyer has up to 12 months to select a replacement puppy of equal value
- If a higher-priced puppy is chosen the buyer agrees to pay the difference
- The seller and buyer will mutually agree whether the affected puppy will be returned or remain with the buyer
- If the puppy is kept the buyer accepts full responsibility for all care and expenses
- If the puppy is returned the buyer is responsible for all shipping costs related to the replacement puppy
In the event of the puppy’s death
- A necropsy (autopsy) must be performed at the buyer’s expense by a licensed veterinarian
- The necropsy must be completed within three (3) days of death to determine the exact cause
- Failure to provide a necropsy within this timeframe will void all guarantees and warranties
Replacement Terms
- If a replacement puppy is not selected within 12 months of confirmation of the defect the replacement is forfeited
- If no puppies are available within 12 months the buyer must choose from the next available litter
- The buyer must select from available puppies only
- If the buyer declines available puppies no replacement will be provided
Conditions Not Covered
The breeder does not guarantee
- Size weight color temperament or reproductive ability
- Hernias
- Open fontanel (common in toy and babydoll-type breeds)
- Collapsed trachea
- Parasites
- Hypoglycemia
- Luxating patella
- Any condition that is treatable manageable or correctable over time or through veterinary care These conditions are not grounds for return or replacement
Veterinary Records & Ongoing Care
- Buyers will receive copies of vaccination and veterinary records
- Buyers must follow their veterinarian’s recommendations for vaccinations deworming and overall care
- If the puppy is ever returned to the seller all veterinary records (including care provided by the buyer) must be submitted to the seller
Non-Transferability
This guarantee is non-transferable and becomes void if the puppy
- Is sold or transferred to a third party
- Is given away
- Is advertised for sale at any time within the first year
Financial Responsibility
- The seller is not responsible for any veterinary bills incurred by the buyer
- The seller’s sole liability is limited to replacement with a puppy of equal or lesser value
- No refunds or returns are offered
No Other Warranties
Other than what is expressly stated in this guarantee no additional warranties—express or implied—are provided
Pet-Only Sale
This puppy is sold as pet only with no registration
Governing Law & Venue
This guarantee shall be interpreted in accordance with the laws and statutes of Riverside County California
Any litigation related to this agreement shall
- Be filed only in Riverside County California
- Be conducted as a non-jury proceeding
- Be limited to Small Claims Court
Confidentiality
Buyer agrees that all dealings communications, and actions related to this transaction and guarantee are strictly confidential unless written or emailed permission is granted by the seller This confidentiality obligation is not limited to the one-year guarantee period or the lifespan of the dog.
Failure to comply with this agreement constitutes a breach of contract, and the buyer agrees that the seller may seek maximum damages allowed in Riverside County, California Small Claims Court.
